AGL Energy (AGL), developer of the Mt Bryan wind farm (Hallett 3) in mid-north South Australia near the township of Hallett, has today agreed to refer a technical question about aspects of the development to the Environment Court for further consideration.

In November 2010 the Environment Court upheld the council's original development consent for the Mt Bryan wind farm which was granted in mid-2009. The appellant lodged a further appeal in the Supreme Court in December 2010.

In September 2011 the appellant raised a further technical question that had not been raised in the original Environment Court appeal.

AGL agreed with the Supreme Court that the Environment Court was better placed to consider the question. AGL believes that the technical question raised will not affect the wind farm.

With both parties consent, the Supreme Court has referred the matter back to the Environment Court for its consideration of the technical question without making any determination of that question, or any other issue raised in the appeal.
