AER commences legal proceedings in South Australia
AGL today announced that the Australian Energy Regulator (AER) has commenced legal proceedings in the Federal Court against AGL and other wind farm operators in relation to allegations by the AER that AGL has breached certain obligations under the National Electricity Law.
The allegations relate to the performance of wind farms operated by AGL in South Australia on 28 September 2016 when South Australia experienced a state-wide blackout during a severe weather event.
The allegations, which are highly technical in nature, relate to the response of the Hallett 1 (Brown Hill), Hallett 2 (Hallett Hill), North Brown Hill and The Bluff wind farms during the weather event.
AGL has previously stated that it considers that it has complied with its legal obligations in relation to the events of 28 September 2016 but will review the allegations made by the AER and consider its position.
