Terms and Conditions

AGL NSW Seniors Festival 2020

1. Information on how to enter and prize details form part of these terms and conditions. By entering this promotion, you’re deemed to have accepted these terms and conditions.

2. This promotion is run by AGL Energy Limited (ABN 74 115 061 375) of Level 24, 200 George Street, Sydney NSW 2000 (“AGL”), phone: 131 245 (we, us, our).

3. The promotion starts at 8:00AM AEDT/AEDST on 13/02/2020. Entries close and must be received by 5:00PM AEDT/AEDST on 14/02/2020 (promotion period).

Who can enter?

4. Entry is via attendance at the AGL stall at the ‘New South Wales Seniors Festival Expo 2020’ at the International Convention Centre, Sydney (Festival) only

5. Entry is open to residents of New South Wales who hold a valid New South Wales Seniors Card. Employees, officers or contractors, and their immediate families, of us and our associated organisations, are ineligible to enter.

6. Entrants under 18 years old must have parental or guardian consent to enter. The parent or guardian agrees to these terms and conditions of the promotion.

7. By entering the promotion, you agree to participate in our marketing activities including being interviewed and photographed, and that we (or our agent) may use your name, voice, photo and comments for marketing purposes at any time and in any media without reference or compensation to you.

How do you enter?

8. To enter, you must, during the promotion period:

    8.1 attend the AGL stall at the festival on either day during opening hours;

    8.2 provide your contact details (including name and phone number) via the AGL online form at the NSW Seniors Festival; and

    8.3 agree to be contacted by an AGL representative to discuss AGL offers for products and services; and

    8.4 select a Spin Occasion and wheel number (eligible entry).

9. Each entrant may only submit one entry.

10. Incomplete, incorrect or illegible entries will be considered invalid.

11. All entries become our property.

Prize

12. The prizes available to be won in this promotion comprise of: Grand Prize: one of 10 x 6 months' worth of free energy from AGL to the value of $500 (one (1) per Spin Occasion); and Runner up Prize: one of 20 x $10 EFTPOS Gift Card (two (2) per Spin Occasion).

13. The total prize pool value is $5,200 (inc GST).

14. Winner(s) will be notified by telephone and in writing within 2 days of the draw. The name of the winner(s) will be published on www.agl.com.au/seniorsprize on 20/02/2020.

15. Our decisions about this promotion (including the selection of winners) are final and no correspondence will be entered into.

Winner determination

16. Throughout the festival, we will award instant prizes using a physical spinning wheel located at the AGL stall. We will carry out ten (10) prize distributions during the promotion period (each a Spin Occasion), each consisting of three (3) x separate spins to award one (1) x grand prize and two (2) x runner up prize(s).

17. Spin Occasions are as follows:

18. Entrants will be invited to select a spin time from one of the ten (10) x Spin Occasions set out in the table above and nominate an available number on the wheel between 1 and 48 for their spin. Each number on the wheel may only be selected once per Spin Occasion. Each entrant’s preferred Spin Occasion and nominated wheel number will be manually recorded against the entrant’s name.

19. Only one (1) Spin Occasion per person is permitted. Entry in any subsequent Spin Occasion after the first valid Spin Occasion will be deemed invalid.

20. Once all 480 numbers have been allocated no further numbers will be made available.

21. At each Spin Occasion, the first winning number will receive the grand prize. The next two (2) winning numbers will receive a runner up prize. In the case that a winning number on the wheel has not been allocated to an Entrant, the number represents a ‘blank’, and we will continue to spin the wheel until all three (3) prizes have been awarded.

22. Entrants are invited to attend their nominated Spin Occasion, however those winning entrants not in attendance at their Spin Occasion will be notified personally within three (3) business days of their winning spin. All reasonable steps to notify the winner(s) of the results of the Spin Occasion will be taken by us. Our decision is final and no correspondence will be entered into.

23. Winners will be published on our website via the following link agl.com.au/seniorsprize (Promotional Website) on 20/02/20 and will remain on the website for no less than twenty-eight (28) days.

24. An unclaimed prize draw will take place on the same day and place as the original draw. The Promoter will allocate five (5) additional reserve Entries in each Spin Occasion (determined by spinning the wheel) and record them in order. In the event of an invalid Entry or ineligible Entrant, or if an Entrant declines the prize or does not claim the prize after 3 months, the prize will be awarded to the first reserve entry in the respective Spin occasion. If the prize cannot be awarded to the first reserve Entrant for one of the reasons outlined above, the Promoter will continue this process until the prize is awarded. Winners will be notified by telephone and writing within 2 days of the unclaimed prize draw. The name of the winner(s) will be published on agl.com.au/seniorsprize

Prize conditions

25. Only one prize per eligible entry.

26. We reserve the right to withdraw a prize if there are no eligible entrants to receive it.

27. A prize, or any unused portion of a prize, can’t be transferred, exchanged or redeemed for cash. Expenses relating to prize(s) are the responsibility of the winner(s).

28. In order to accept a prize, a winner may be required to sign a legal release and indemnity form.

29. Grand prize winners must live in areas of NSW where AGL supplies electricity or gas. If the grand prize winner is not an existing customer of AGL at the time of the prize draw, they must sign up to an AGL gas or electricity plan within 3 months of being notified that they are a prize winner in order to redeem the grand prize.

30. The grand prize will be awarded as a credit on the grand prize winner's AGL electricity account, unless the grand prize winner nominates for it to be applied to their AGL gas account

General

31. We reserve the right to: (a) ask you to provide proof of identity and/or proof of eligibility to claim a prize, (b) determine how the promotion is run, including the selection of a winner, and (c) disqualify any entrant who we believe has breached these terms and conditions or engaged in unlawful or other improper conduct or any conduct intended to jeopardise the fair and proper conduct of the promotion.

32. We accept entries upon receipt by us. It’s your responsibility, not ours, to ensure we receive your entry.

33. We aren’t responsible for a prize that may be lost, stolen, forged, damaged or tampered with after it leaves us or our agent, or changes in prize value.

34. If we’re unable to provide a winner with a prize (or part of a prize), we’ll supply an alternative prize (or that part of the prize) of equal or greater monetary value and/or specification, subject to directions from regulators.

35. If we’re unable to run the promotion as planned, including due to tampering, unauthorised intervention, fraud, technical difficulties or any other causes beyond our control, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the promotion, we reserve the right to take any action that we consider necessary, including modifying the promotion, subject to directions from regulators.

36. We exclude all warranties in relation to the quality, suitability or merchantability of a prize, except those that can’t be excluded by law.To the extent permitted by law, any liability of us or our employees or agents for breach of any rights a consumer may have which are unable to be excluded under Australian law is limited to paying for the resupply of the prize.

37. To the extent permitted by law, we aren’t liable for loss (including indirect and consequential loss), damage or personal injury suffered or sustained in connection with this promotion (including the supply of goods or services by anyone to a prize winner), and to anyone accompanying a prize winner if applicable.

38. We're not responsible for tax (including GST) obligations of any nature that may arise from winning a prize, so please seek your own independent tax advice.

Privacy

39. You agree that we may use personal information we collect from you as set out in our privacy policy available at www.agl.com.au/privacy-policy, including: (a) to conduct this promotion and determine and notify a winner, and disclose such information to prize suppliers and regulators, and (b) for marketing purposes at any time and in any media, including to contact you after this promotion ends.
