AGL Rewards Membership

1.2 Eligibility and Access to AGL Rewards 

a) The promoter of the AGL Rewards program is AGL Sales Pty Limited ABN 88 090 538 337 (AGL), which is the sole owner of the AGL Rewards program.  

b) To be eligible for AGL Rewards and be permitted to access this site, you must: 

i. hold an active gas, electricity and/or telecommunications account with AGL and;
ii. be a registered AGL My Account user, with an activated account. 

c) AGL large business customers and ActewAGL customers are not eligible for the AGL Rewards program. 

d) A customer’s access to AGL Rewards will be cancelled if:

   i. AGL reasonably suspects non-compliance with the conditions of clause 1.3(ii), (v) or (vi) below, or reasonably suspects that the customer is otherwise engaging in fraudulent, illegal or vexatious activity.

   ii. the customer no longer holds an active gas, electricity or telecommunications account with AGL. If so, that customer must cease the use of AGL Rewards. All access to AGL Rewards digital assets will be deactivated.  

e) AGL reserves the right to alter or amend the conditions of the AGL Rewards program, or terminate the program, at any time with reasonable prior written notice of any material amendment or termination. AGL may also cease to promote any Reward offer, or vary the terms of a Reward promotional offer, at any time. However AGL will honour any originally advertised Reward offer during the originally advertised redemption period.

f) Information collected by AGL relating to your AGL Rewards participation and use of the AGL Rewards website may be used by AGL for marketing, planning, product development, research and other commercial purposes. 1.3 AGL Rewards 

Unless otherwise stated: 

i. The Reward can only be redeemed with the applicable Third Party and not with AGL; 

ii. The Reward is valid for one person only;  

iii. You must redeem the Reward from the Third Party within any applicable redemption period.  If you do not redeem the Reward within the stated redemption period, the Reward will expire and can no longer be redeemed; and 

iv. You must follow the redemption instructions associated with the Reward when you redeem the Reward with the Third Party;  

v. You must not reproduce a Reward or disclose a Reward to another person for their use. 

vi. Each Reward is for your non-commercial, personal use only; and 

No Reward is redeemable for cash or cash equivalent or will entitle you to a credit, cash refund or new Reward.  

1.4 Responsibility for the Third Party Offering 

a) Please note that the Third Party, and not AGL, is: 

i. the seller, supplier and/or provider of the Third Party Offering;
ii. solely responsible for the sale, supply, provision and delivery of the Third Party Offering; 
iii. the party who enters into a contract with you when you redeem your Reward; and 
iv. solely responsible for providing you with the Third Party Offering and for the Third Party Offering itself.

b) You must familiarise yourself with any terms and condition that may apply to the Third Party Offering and ensure that they are acceptable to you prior to redeeming any Reward.  

c) Under no circumstances is AGL acting as the agent of the Third Party or as a supplier, re-seller or distributor of any Third Party Offering. 

d) Subject to clause 1.7 below, in accessing AGL Rewards, you agree that AGL is in no way responsible or liable to you for any products or services you purchase from a Third Party linked from an AGL Rewards webpage or in connection with the redemption of a Reward, including for any product liability claim, improper charges, delivery failures, pricing errors, or inaccurate product descriptions or information. 

e) If you redeem your Reward, but the Third Party does not provide the Third Party Offering, or if you have a complaint regarding the provision of the Third Party offering, you must take action against the Third Party directly. Subject to clause 1.7 below, the Third Party, and not AGL, will in all circumstances be responsible for the supply and/or the provision of the Third Party Offering.   

f) AGL does not promise or guarantee that the product details, prices, coupon availability or other service terms, rates or rewards offered by any particular advertiser or other third-party via AGL Rewards are the best prices, terms or lowest rates available in the market. 

1.5 Copyright

a) The subject matter on, and accessible from, the AGL Rewards site is the subject of copyright protection. With the exception of fair dealing permitted by the Copyright Act 1968, AGL grants users of the site permission to download and display AGL copyright material only for private purposes. For any other reproduction or use of AGL copyright material, permission must be sought directly from AGL. If provided, permission will be subject to the requirement that the copyright owner's name and interest in the material be acknowledged when the material is reproduced or quoted, in whole or in part. 

b) Unless otherwise stated, AGL does not warrant or represent that the information on other web sites does not infringe the intellectual property rights of any person anywhere in the world. 

1.6 Links to Other Sites

a) In connection with AGL Rewards, AGL will provide links to other websites belonging to Third Parties and other parties. AGL does not endorse, warrant or guarantee the products or services available through any link (or any other third -party products or services advertised, presented on or linked from any portion of AGL Rewards), whether or not the subject of a Reward. AGL is not an agent, distributor, re-seller, broker or otherwise responsible for such third-parties or the activities or policies of those websites or the products or services. available on them.  

b) When you access third-party websites via AGL Rewards, you accept that there are risks in doing so, and that AGL is not responsible for such risks. AGL encourages you to be aware when you leave AGL Rewards and to read the terms and conditions and privacy policy of each third-party website or service that you visit or utilize.  

c) AGL has no control over, and assumes no responsibility for, the content, accuracy, privacy policies, or practices of or opinions expressed in any third-party websites or by any third-party that you interact with through AGL Rewards. In addition, AGL will not and cannot monitor, verify, censor or edit the content of any third-party site or service. By using AGL Rewards, you release and hold AGL harmless from any and all liability arising from your use of any third-party website or service.
